Terms and conditions of sale

By registering for a course at Aftenskolen, or by purchasing an online course, you confirm that you have read and accepted the following terms: 

§Section 1 Definitions 

Agreement - the Agreement means these standard terms and conditions 

Courses - courses refer to courses and study programs offered by Aftenskolen, either physical classroom courses or live courses in virtual classrooms. This includes course dates, study programs, curricula, teaching staff and more. 

Online courses - refers to asynchronous web-based courses that the participant has immediate access to. 

Customer - refers to an individual or legal entity that has purchased or enrolled in a course at Aftenskolen. 

Service - refers to Courses and Online Courses combined. 

Website - refers to Aftenskolen.no 

Parties - refers to the Evening School and the Customer jointly 

§2 Evening school 

Aftenskolen is a Norwegian foundation with organization number 927 408 236. We have offices in Kongensgate 29, 4610 Kristiansand and Strandkaien 28, 4005 Stavanger. 

§3 Purchase and registration 

The service can be purchased by anyone. To participate in Aftenskolens Courses, the Customer must be pre-registered. All registrations are binding. The Customer is considered to have registered when Aftenskolen has sent written confirmation that registration has been received. Such confirmation can be sent by letter, e-mail, SMS, electronic message or similar. 

When purchasing Online Courses, the Customer receives a limited, non-exclusive and revocable right to access the relevant Online Course(s) purchased. The access cannot be licensed to others. Unless otherwise described in the product description, access to the individual Online Course is personal. Access rights may therefore not be transferred or used by a third party. 

§Section 4 Right of withdrawal and deregistration 

The customer can cancel/change the registration without further justification up to 7 (seven) days before the start of the course. Any course fees paid will be refunded according to the following model:

Cancellation 14 days before course start: 100% refund

Cancellation 8-13 days before course start: 50% refund

Cancellation 7 days before course start: no refund

If the Customer cancels/changes the registration after this deadline, the course fee must be paid in full. 

If the cancellation is due to illness, death in the immediate family or other unforeseeable event (force majeure) that makes it impossible to start or complete the course and the reason for the cancellation is documented by a medical certificate or other relevant documentation, part of the course fee will be refunded even if the cancellation occurs within 5 working days before the start of the course. In such cases, the course fee will be calculated according to how many course evenings the Customer has attended, but with a lower refund limit of 25% of the course fee.

In order to exercise the right of withdrawal, the Customer must notify Aftenskolen's administration in writing. The message must clearly state that the Customer is exercising the right of withdrawal. Notification to the teacher or non-attendance is not a valid notification of withdrawal. In such cases, the course fee must be paid in full. 

For Online Courses, a 14-day right of withdrawal applies unless the relevant Online Course has begun. If the Online Course has begun, there is no right of withdrawal. 

§5 Payment 

Course fees must be paid before the start of the course unless otherwise agreed. If payment is made after the due date, a reminder fee will be added. Unless otherwise stated in the course description, expenses for books, materials and any exam fee/semester fee will be added to the course fee. 

§Section 6 Purchase of subscription 

When the Customer takes out a subscription with Aftenskolen, the Customer will be able to access the Online Course(s) covered by the relevant subscription. The subscriptions vary in price and content. Subscriptions are paid monthly and in advance using the payment options available at any time via the Website. There is no refund or credit on commenced monthly subscription periods. The subscription runs until the Customer terminates it. Termination must take place no later than the day before a new billing period commences. If the subscription is not canceled by that time, the Customer will be charged the monthly fee for the next billing period. 

Aftenskolen has the right to change the price of the subscription by notifying the Customer within a reasonable time. Notified price changes will take effect for the following subscription period. By continuing to use the Service after the price change takes effect, the Customer accepts the new price. 

§Section 7 Implementation 

Aftenskolen has the right to make changes to the Courses, including course arrangements, curricula, teaching staff, tuition fees, teaching times and more; provided that the changes do not entail a significant inconvenience for the Customer, or that the changes entail a significant change to the original Course. The Customer will be notified of the changes within a reasonable time. 

For Online Courses, Aftenskolen may upgrade, modify, change or improve the various Online Courses, as long as it does not cause significant inconvenience to the Customer's use of the courses. 

Aftenskolen has the right to cancel courses and educations that do not have a sufficient number of enrollees, or which, due to other unforeseen circumstances, make the implementation of the course difficult. In such cases, the Customer shall be notified that the course is canceled. Course fees paid will be refunded in full. 

As a general rule, Courses in the Evening School follow the schools' holidays and days off unless otherwise stated. 

After completing the course, the Customer can request a course certificate from Aftenskolen. This only applies if the Customer has attended at least 75% of the course sessions. 

§Section 8 Copyright  

Courseware, course materials and other content related to the Service are protected by Norwegian and international copyright laws. . 

Consequently, it is not permitted to: 

a) rent, lease, sublicense, resell, distribute, transfer, copy or modify elements of the Service or any of its components.

 b) reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit the Service or any part of it without the written permission of Aftenskolens administration. 

c) remove or alter any copyright, trademark or other proprietary rights markings from originals or copies of material included in the Service. 

d) use the Service in any way, or utilize any content, data, or other material, that infringes or violates any patents, copyrights, trade secrets, trademarks, or other intellectual property rights of any third party, or that constitutes defamation, libel, invasion of privacy, or violation of trade dress or other third party rights, or that is threatening, harassing, or harmful to Aftenskolen and/or third parties. 

No intellectual property rights are transferred to the Customer in connection with the purchase of access to the Service. Aftenskolen's name, company logo, and all related names, logos, product and service names, designs and slogans are trademarks of Aftenskolen, the Service, the Website or its affiliates or licensors. The Customer may not use such marks without the written permission of Aftenskolen. All other names, logos, product and service names, designs and slogans used in the Service are trademarks of their respective owners. 

Courses labeled with CC BY-SA 4.0 are exempt from this section.

§Section 9 Personal data 

When purchasing Services, the Customer is added to Aftenskolen's customer database. In order to have access to Online Courses, the Customer must also have a valid account on the Website. In this connection, the Customer must provide personal information such as name, email and telephone number. 

Aftenskolens collects and stores personal data only to the extent necessary to provide the Service to the Customer. The collection and storage of the Customer's personal data is regulated in Aftenskolens' privacy policy, which the Customer can read here: LINK 

§ Section 10 Information 

By purchasing the Service, the Customer agrees to 

a) provide true, accurate, up-to-date and complete information in accordance with the requirements for registering an account or using the Service

b) updating registered data to keep it correct, accurate and complete 

c) inform Aftenskolen immediately of any unauthorized use of their account, or suspected misuse of personal data

d) keep your username and password secret. 

Aftenskolen cannot be held responsible for any loss or damage resulting from the Customer's failure to comply with the above points. 

§Section 11 Change of terms and conditions 

The Evening School will from time to time revise and amend the Service and this Agreement to reflect changes in business needs, including, but not limited to, changes in teacher capacity, features and functionality, changes in market conditions, changes in technology, changes in payment methods and changes in relevant laws and regulations. 

The changes will enter into force at the earliest 14 days after they have been communicated to the Customer, either through direct communication or through publication on the Website. 

Continued use of the Service after the announcement of amended terms and conditions means that the Customer accepts and agrees to the changes as long as the amended terms are not unfavorable to the Customer. 

 §12 Force Majeure 

The Evening School is not liable for any loss, damage or delay caused by unforeseeable events beyond the control of the Evening School ("force majeure"). 

Force majeure includes any act, event, non-event, omission, or accident beyond the control of Evening School, including, but not limited to, limitations imposed by law, regulation, order, or other governmental directive, strikes, natural disasters, third party mechanical or other equipment failures, terrorist attacks, fire, explosions, fiber optic cable cuts, interruptions or failures of telecommunications or digital transmission connections, internet failures or delays, storms, or other similar events. 

§12 General reservations 

Customer's use of the Service or items obtained through the Service is at its own risk. The Services are provided "as is", without warranties of any kind, direct or indirect. Thus, Aftenskolen does not warrant or assume responsibility that the content provided by Aftenskolen, including from experts, is accurate, complete and error-free. Furthermore, Aftenskolen makes no warranty that the Service will be error-free or uninterrupted, that errors will be corrected, or that the Service or products obtained through the Service will meet the Customer's needs or expectations. 

Aftenskolen disclaims any liability for loss or damage that may arise as a result of the Customer's use of information and knowledge acquired through the use of the Service. 

Aftenskolen reserves the right to make any typographical errors on the Website, in the course information, course descriptions, examination syllabuses and other documentation that Terms of Sale 6 applies to the Service. The Website may contain links to other websites that are not operated by or related to Aftenskolen. Aftenskolen is not responsible for the content, accuracy or opinions expressed on such third party websites and is not obliged to investigate, monitor or check these websites for accuracy or completeness. 

A Customer who leaves the Website to access third party websites does so at their own risk. 

§Section 13 Dispute resolution 

The agreement is governed by Norwegian law. The parties shall seek to resolve any disputes in connection with the understanding of these Terms and Conditions through negotiations. If negotiations are unsuccessful, the dispute shall be resolved by ordinary court proceedings with Stavanger District Court as the venue.
